Washington, United States: The government of the United States has issued a ‘landmark Executive Order (EO)’ to manage the risk associated with Artificial Intelligence (AI). The government has outlined that the motive behind the signing is to seize the opportunity and manage the risks of AI.

According to the reports, the newly signed order not only focuses on the new guidelines to protect the privacy of the citizens of the United States but also appeals to attract talent from the world.

It has been anticipated that the authorities will use the technology to modernize and streamline visa criteria, interviews, and review applications. It is expected that AI will help to expand the ability of highly skilled immigrants and non-immigrants with AI expertise to study, stay and work in the nation.

Experts predicted that this will be good news for Indian IT professionals in the United States. It could lead to quicker processing of visas like H1B, O-1, and F1, as well as green cards for those working or studying in the field of Artificial Intelligence. Additionally, the criteria for EB1-B and EB2 visas are expected to be adjusted to give more importance to AI workers.

All the details were shared by Anil Gupta, in his blog, who is an immigration expert from the United States.

He has further expressed that this executive order will not provide any push for additional green cards or any country-wise benefits, outlining that EB1 and EB2 categories can be reformed.

Anil can be quoted as “It is possible that USCIS will create a relaxed or separate category within EB1-B where they allow people to work in the AI field.”

New order’s impact on AI professionals

According to the reports, the new guidelines are specifically focusing on the nationals who are working in the field of Artificial Intelligence. It will analyze, create, and publish the policies to stay and convert to green card status.

It is to be noted that the authorities have been working to identify and attract top talent in the AI field at universities in the United States within the time span of 90 days.

According to the immigration expert Gupta, the new guidelines seek to “streamline processing times of visa petitions and applications, including by ensuring timely availability of visa appointments, for non-citizens who seek to travel to the US to work on, study, or conduct research in AI or other critical and emerging technologies.”

He has further outlined that easy immigration for AI workers has been ensured. In this regard, the secretary has been asked to renew the domestic visa program under 22 CFR 41.111(b) “to facilitate the ability of qualified applicants, including highly skilled talent in AI and critical and emerging technologies, to continue their work in the United States without unnecessary interruption.”

EO, in a bid to reform the process of immigration for professionals, seeks to simplify and modernize immigration options for experts in fields like AI and emerging technologies. Accordingly, this will include individuals with exceptional skills, such as those holding O-1A and EB-1 visas, as well as advanced-degree holders (EB-2) and innovative startup founders in AI and similar cutting-edge fields. The International Entrepreneur Rule will be utilized to facilitate these changes.
