United States: The Texas Supreme Court is in the headlines after rejecting the request of a woman for immediate abortion because of ‘harrowing’ pregnancy complications.
According to the reports by the Associated Press, Texas is among several Western states which has been discussing the developments and witnessing court arguments related to the state abortion policies this week.
In a few cases, petitioners are putting efforts to end the abortion bans, mostly in the Republican-controlled states where it has been enforced since last year. They also quest for clear rules about exceptions for certain pregnancies.
HERE IS THE BREIF OF A FEW OF THE CASES:
Texas court denies Abortion request!
The Texas case is regarded as the one the most watched of all abortion ban lawsuits.
Recently last week, Katie Cox started a legal battle to secure her right to end her pregnancy. By that time, she was 20 weeks pregnant with a fetus to die in utero or shortly after birth; she also argued that carrying the child would also make her health critical as well as future fertility.
However, on Monday, the Texas Supreme Court declined her abortion request and cited that “she didn’t qualify for the exceptions to the abortion bans in state law,” the news agency AP reported.
Although she traveled to another state, according to her doctors, by the time the decision was made.
In a similar incident, lawyers of a woman in Kentucky, who took legal action against the state’s ban like the previous case, mentioned that the heart of the embryo she was pregnant with was no longer beating.
Idaho women are eagerly searching for answers on exceptions!
A case was filed by women in Idaho who all wanted to abort their child because doctors warned them that they might have a miscarriage or their child could die shortly after birth. But after finding no support from the Court, all four traveled to Oregon or Washington, and out of the total, three received abortions.
It is to be noted that a lawyer for the state of Idaho was expected to initiate a legal battle on Thursday in the Boise judge to challenge the abortion ban – implemented by the state. According to AP, similar to the lawsuits in Tennessee and Texas, the petitioners are the women who are looking forward to abortion due to complications in their pregnancies.
Legal showdown unfolds: Clash of state and local laws in New Mexico!
It is to be noted that Democrat-led New Mexico is free from any abortion law and it is regarded as a haven for the women from nearby states, such as Texas, who find it difficult to abort despite all health complications.
However, as per the reports by the Associated Press, a few conservative city and county has implemented their own rules. Earlier this year, Gov. Michelle Lujan Grisham signed a bill that cancels out the rules that were set up in Lea and Roosevelt counties and in the cities of Hobbs and Clovis.
An argument about the right to do so took place at the State Supreme Court on Wednesday.
Abortion drug case to be heard in 2024 in US Supreme Court
The Supreme Court of the United States will be taking up an abortion-drug case next year – in its current term.
The case will focus on whether the government properly allowed the use of mifepristone, one of the two drugs usually used together for most medication abortions. If the appeals court decides a certain way, it could stop people from getting the drug by mail and put other limits on its use.
The case will be the first-ever abortion case in the highest Court of the US since Dobbs vs Jackson Women’s Health Organisation last year.
